STATEMENT OF PURPOSE
This legislation strengthens Idaho’s response to child custody interference by clarifying child custody interference as intentionally withholding a minor child from someone with lawful custody, visitation, or parental rights without authority. It refines defenses, adding a detailed exception for temporary, unavoidable delays in return that don't count as interference if a law enforcement officer reasonably accepts the explanation on scene. It establishes a graduated penalty framework that begins with infractions for first offenses and escalates to misdemeanors and felonies for repeat conduct. The language preserves court authority to award violator-paid location expenses and compensatory custody/visitation time under existing law.It directs law enforcement to respond to reports by verifying the child's location, conducting a welfare check, and filing a report.
