MOTOR VEHICLE INSURANCE -- Amends existing law to provide a felony penalty for a third or subsequent violation of driving without insurance within a period of 5 years.
STATEMENT OF PURPOSE
ThepurposeofthislegislationistoamendIdahoCode§49-1229(5)toprovideforhigherpenaltiestopersons who continue operating motor vehicles without insurance upon the third offense within five (5) years. Idaho Code § 49-1229(5) relates to the applicable penalties for failing to drive a motor vehicle without the required motorvehicleinsurance. Thecurrentstatuteprovidesforaninfractiononthefirstoffenseandamisdemeanor on any subsequent offense within five (5) years of the first offense. This amendment will provide that the failure to carry the required motor vehicle insurance for a third time and any subsequent offense thereafter within five (5) years of the first offense will result in a felony.
